BGH Ruling 2026: Losses in Illegal Online Casinos Fully Recoverable

The Federal Court of Justice finally confirmed in May 2026: Anyone who has lost money at a non-GGL-licensed online casino can reclaim the entirety of their lost funds. Here's what players need to know now.
With the landmark ruling of May 14, 2026 (Case No. XII ZR 187/25), Germany's Federal Court of Justice (BGH) has definitively settled a question that has been disputed for years: losses suffered by German players at online casinos not licensed by the GGL can be fully reclaimed. The judgment confirms the case law of several Higher Regional Courts and finally creates legal certainty for the estimated 1.2 million players who have been active with illegal providers in recent years.
The BGH's reasoning is clear: gambling contracts with providers lacking a German GGL license are void according to § 134 BGB in conjunction with § 4 Abs. 1 GlüStV, as they violate a statutory prohibition. Consequently, all player payments are considered to have been made without legal basis under § 812 Abs. 1 BGB and must be refunded by the casino. Offsetting these claims with any winnings is possible, but this only limits the amount to be paid out, not the fundamental right to reclaim. The BGH also unequivocally rejected arguments such as "the player knew they were playing with an illegal provider."
Specifically affected are all online casinos that do not hold a GGL license—particularly providers with licenses from Malta (MGA), Curaçao, Gibraltar, or the old Schleswig-Holstein license. Well-known international brands that continue to serve the German market despite lacking a license thus fall under this ruling. The standard limitation period for claims is three years from the time the player becomes aware of the illegality, and in special cases, it can extend to ten years. Therefore, anyone who has lost money with an illegal provider since 2016 may be able to reclaim these losses, depending on their individual situation.
The practical implementation involves three steps: First, the player must request a complete account history from the casino (right of access under Art. 15 GDPR). Second, deposits and withdrawals are offset—the difference is the reclaimable net loss. Third, a written demand for repayment is sent to the casino; if it refuses, a lawsuit is filed at the competent local or regional court. Most illegal providers are based in other EU countries, but enforcement of judgments is generally possible thanks to the EuGVVO Regulation.
Specialized casino lawyers typically charge a fee between 25% and 35% of the successfully recovered funds for these proceedings, depending on the amount of loss, complexity, and region. Lustich.de now lists 150 specialized gambling law attorneys in the DACH region, from Berlin and Munich to Vienna and Zurich. Importantly, most legal insurance policies do not cover these cases, as playing with illegal providers can be classified as "deliberately unlawful conduct." Many lawyers therefore offer a contingency fee to make it easier for players to file a lawsuit.
For providers with a GGL license—meaning all the casinos recommended by Lustich.de—the ruling is not a threat. On the contrary, it significantly strengthens player trust in the regulated market. Anyone who plays at JackpotPiraten, OnlineCasino DE, Merkur Slots, Tipwin, bwin Casino, or any other GGL provider is entering into a fully legal contract. Payouts are guaranteed, player protection measures are in effect, and in the event of a dispute, the GGL's arbitration board is available to players. This is precisely the key advantage of the regulated German market—and it is exactly why Lustich.de exclusively recommends GGL-licensed providers.
Industry reactions to the BGH ruling are predictable: while GGL providers and consumer protection advocates welcome the clarification, some international providers based in Curaçao or Malta are already announcing their withdrawal from the German market—if they were ever officially present in the first place. For affected players, this opens up a clearly defined path to legally recover their losses. Anyone who suspects they have played with an illegal provider in recent years should promptly contact a specialized casino lawyer—a list of qualified law firms in over 150 DACH cities can be found at lustich.de/casino-anwaelte.
