Connecticut lawmakers legalized sports betting and online casinos in May 2021. A new bill from 2024, which received little attention, could however bring far-reaching changes. It aims to tighten advertising guidelines and permit betting on local college teams in certain cases.

Numbers and facts

Sports betting in Connecticut is permitted for individuals aged 21 and older. The market is overseen by the Gaming Division of the Connecticut Department of Consumer Protection (DCP). This market differs from many other US states due to its deliberately limited structure. Operations are based on a three-party framework: the Mashantucket Pequot Tribal Nation, the Mohegan Tribe, and the Connecticut Lottery. These partners collaborate with major industry names, including DraftKings for the Mashantucket Pequot and FanDuel for the Mohegan Tribe. Fanatics is a partner for the Lottery channel.

Online sports wagers are permissible only when the customer is physically located within Connecticut. Geolocation technologies ensure compliance. The soft launch of online betting began on October 12, 2021, with the full launch following a week later, on October 19, 2021. The initial sports wagering revenue share was 13.75%. This is tied to established agreements that provide for a later increase. There are specific betting restrictions for college teams from Connecticut, with few exceptions for tournaments. Betting on high school and youth events is completely prohibited.

A new bill (File No 271, substitute for HB 5284) from 2024 mandates stricter advertising guidelines. For instance, it bans the use of celebrities in advertisements. Furthermore, advertising primarily aimed at individuals under 21 years old is to be disallowed. Certain affiliate marketing deals could also be affected, especially those whose compensation "is dependent on, or related to, the volume of individuals who become patrons, the volume or amount of wagers placed or the outcome of wagers."

Background

The Connecticut legislature takes a conservative approach to gambling. This is evident in the strict controls and limited licenses. The new advertising guidelines reflect a broader trend in the US. States like Ontario, Maine, and Massachusetts have introduced similar measures to protect young people and vulnerable individuals. NCAA President Charlie Baker has clearly advocated for a complete ban on prop bets on college players. Responding to this demand, the new bill in Connecticut includes an explicit prohibition of such bets.

Nevertheless, the bill would also pave the way for betting on local college teams in certain tournaments. This is a departure from the current regulation, which completely prohibits such bets. Neighboring states like Massachusetts have similar regulations, which, however, caused confusion among providers there. Senator Tony Hwang expressed concerns after the House vote in May 2021, citing the rapid pace of legal reform. He emphasized that there were many concerns regarding the significant expansion of gambling in the state of Connecticut.

Why it matters for German players

German players operate in a completely different regulatory environment. The German State Treaty on Gambling 2021 (GlüStV 2021) has reorganized the online gambling market in Germany. Providers in Germany must hold a license from the Joint Gambling Authority of the Federal States (GGL). This ensures a high level of player protection. This includes the 1 Euro stake limit per spin for online slots and a monthly deposit limit of 1,000 Euros. Furthermore, LUGAS, a cross-state gambling supervision system, monitors gaming behavior and helps protect against gambling addiction.

In Germany, advertising for online gambling is also strictly regulated. Inducements or advertising aimed at minors are prohibited. The German system strives to create a safe gaming environment. It places great emphasis on transparency and responsible gaming. This contrasts with unregulated offers abroad, which often do not provide comparable protection mechanisms. Players should therefore always check whether an online casino holds a German GGL license. Providers without this license operate illegally in Germany. German players who play in an unlicensed casino not only expose themselves to legal risks but also forgo important player protection measures.

What it means for GGL-licensed casinos

The developments in Connecticut, especially the stricter advertising guidelines, highlight an international trend towards stronger regulation of gambling advertising. For GGL-licensed casinos, such provisions are not new. The GlüStV 2021 has already established comprehensive rules for marketing. These aim to protect underage and vulnerable players. Casinos with a German license, for example, are not allowed to advertise with "guaranteed winnings." They must avoid content relevant to youth protection.

The debate about affiliate marketing deals in Connecticut could also be relevant for the German market. While there are no direct prohibitions on revenue-based affiliate models here, the GGL monitors advertising very closely. Cooperations with partners who do not comply with the strict German advertising guidelines can have consequences for licensed casinos. Transparency and compliance with youth protection regulations are crucial. Developments in the US, particularly the reaction to prop bets in college sports, could also spark discussions in Germany in the long term. Here, bets on league games in youth sports are already excluded. The GGL's focus is on continuously improving player protection and providing a safe gambling environment.
