Illinois plans higher taxes on sports betting and prediction markets

Illinois has passed a new law introducing taxation for prediction markets and increasing levies for sports betting operators. Since 2020, over $59 billion in bets have been placed in Illinois, generating over $1 billion in tax revenue.

The US state of Illinois is planning extensive tax increases for sports betting operators and a new levy for transactions on so-called prediction markets. This stems from Senate Bill 3019 recently signed into law by Governor JB Pritzker. The measures aim to boost state revenues but are facing significant opposition from the gambling industry.

This decision follows earlier efforts by the state to tighten the regulation of prediction markets and curb their potential misuse. Sports betting and prediction market operators warn of negative consequences for the regulated market and players.

Numbers and facts

The new legislation introduces a tax on prediction market transactions. The first five million trades will be subject to a 1.75% tax, with the rate increasing to 3.5% on any trades beyond that threshold. These prediction markets are currently regulated by the Commodity Futures Trading Commission (CFTC).

For sports betting, Illinois already amended the Sports Wagering Act in May 2025 to introduce a per-wager tax on online sports bets. This measure became law on June 17, 2025, and took effect a few weeks later. The Illinois Gaming Board reports a sharp rise in tax revenue since this initial increase, climbing from $393 million in fiscal year 2025. These funds are used to support a range of state programs.

However, this higher tax coincided with a decline in betting activity. Data comparing May 2025 with May 2026 shows a 21% year-over-year drop in the number of bets placed after the new tax took effect. Illinois' sports betting handle also fell 10.2% year-over-year in May, dropping to $1.1 billion. Since its legalization in 2020, sports betting in Illinois has seen over $59 billion wagered, generating over $1 billion in tax revenue.

The budget approved by Illinois lawmakers on May 31 stipulates that operators will pay a tax of $0.25 on wagers up to the first $20 million in handle. Beyond this threshold, licensees will pay a $0.50 tax for each bet. This means larger operators are expected to shoulder a greater burden. DraftKings and FanDuel, for example, have announced a $0.50 fee on mobile and online bets, effective September 1. DraftKings CEO Jason Robins voiced his concerns:

"We’re disappointed Illinois policymakers have chosen to more than triple our tax rate over the past two years." - Jason Robins, CEO of DraftKings

Background

The state's motivation behind these tax increases is clear: to tap into the rapidly expanding prediction and sports betting markets for additional revenue. Illinois previously tightened ethics standards across various fields, including new rules to curb potential abuse in prediction markets. However, the industry stakeholders, including the Sports Betting Alliance (SBA) with members like DraftKings and FanDuel, argue that higher taxes discourage bettors from using regulated sportsbooks and push them towards unregulated, illegal markets. Json Robins from DraftKings reiterated this point, stating that Illinois continues to fuel the rapidly growing illegal industry.

Prediction market operators, such as Kalshi, together with the CFTC, have filed a lawsuit against the state. The case is currently pending before the US District Court for the Northern District of Illinois. Until this case is resolved, which could take years, the state cannot implement the event wager tax. This legal battle highlights the contentious nature of these new tax policies and the industry's resistance.

This is the state’s second tax increase on the industry in a year. The FY2025 budget, approved a year ago, introduced a sliding-scale tax system on gambling, particularly pressuring the state’s largest licensed sports betting operators. Operators with revenue exceeding $200 million, namely DraftKings and FanDuel, had to pay 40% of their Adjusted Gross Revenue (AGR).

What it means for GGL-licensed casinos
